Other Relevant Georgia PFAS Litigation

City of Rome

In November 2019, the City of Rome, Georgia, filed a lawsuit against multiple defendants engaged in the carpet manufacturing process in and around Dalton, GA including Mohawk and Shaw. It also sued the manufacturers of PFAS chemicals including 3M. The lawsuit accused the defendants of contaminating the Oostanaula River with PFAS chemicals. According to the lawsuit, PFAS pollutants pervasively and severely affected Rome's drinking water supply, as the river serves as a primary water source.
Rome's lawsuit sought to hold defendants accountable for the ongoing pollution and to recover costs related to mitigating the contamination, such as the installation of advanced water filtration systems.

On May 30, 2023, up to 30 of the defendants entered into a settlement agreement with the City of Rome to resolve the 2019 litigation. According to press reports, the City of Rome will receive at least $223 million from various defendants including:

The settlement will also cover the cost of the new $100 million water treatment plant in Rome to ensure the safety of its water system. City officials initially implemented water rate hikes to pay for the facility, but those were rolled back in June when the settlement was accepted.

Interestingly, five of the defendants including 3M and Dupont, the giant multinational companies who manufacture PFAS chemicals, sued to stop the release of the terms of the settlement.

Despite the delays in releasing the settlement information, Rome has received over $130 million from 32 defendants, with settlements totaling more than $159 million. The funds are being used to cover the costs of PFAS filtration and water treatment improvements, including a new reverse osmosis facility​ (WRGA)​ (National Law Review).
